Welcome to Journoo AI. These Terms of Service (“Terms”) govern your access to and use of the services provided by Journoo AI, LLC (“Journoo,” “we,” “us,” or “our”), including our website, software applications, and related services (collectively, the “Services”).
By creating an account or using our Services, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years of age to use the Services. By agreeing to these Terms, you represent and warrant that you are at least 18 years old.
2. Our Services
Journoo provides an AI-native journaling application designed to be a private digital space. We offer a free tier of service and a “Premium” subscription with enhanced features. A full description of our current free and premium features is available on our website and in our applications.
3. User Accounts
You are responsible for safeguarding your account information, including your password. You agree to notify us immediately of any unauthorized use of your account.
4. Subscriptions and Payments
- Billing: We offer monthly and annual subscriptions that are billed in advance on a recurring basis. By providing a payment method, you authorize us to charge you the subscription fees automatically.
- Free Trial: We may offer a free trial for our Premium subscription. If you do not cancel before the end of the trial period, you will be automatically charged the subscription fee.
- Cancellations & Refunds: You may cancel your subscription at any time through your account settings.
- Monthly Subscriptions are non-refundable. Your subscription will remain active until the end of the current paid month.
- Annual Subscriptions are eligible for a full refund if requested within 14 days of the initial purchase or renewal date.
- Price Changes: We may change our subscription prices from time to time. We will provide you with at least 45 days’ notice of any price changes. Price changes will take effect at the start of the next subscription period following the date of the change.
5. User-Generated Content
- You Own Your Content: You retain full ownership of the journal entries, notes, images, and all other content you create within the Services (“User Content”).
- Privacy of Your Content: Your User Content is completely private. Our use of client-side encryption means we cannot access, read, or share the content of your journal entries.
- Your Responsibility: You are solely responsible for your User Content. You agree not to use the Services to store or transmit any content that is illegal, infringes on the rights of others, constitutes hate speech or credible threats, or contains malicious code.
6. User Submissions
We welcome your feedback, comments, and suggestions for improvements to the Services (“Feedback”). You can submit Feedback by emailing us or using the feedback mechanisms within the Services. By submitting any Feedback, you agree that your disclosure is voluntary, unsolicited, and without restriction.
You grant Journoo a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive license to use, copy, modify, distribute, create derivative works of, and otherwise exploit any Feedback you provide, for any purpose, without any compensation, credit, or obligation to you.
7. Acceptable Use
You agree not to misuse the Services. This includes, but is not limited to, attempting to:
- Reverse engineer, decompile, or disassemble any part of the Services.
- Breach or circumvent any security or authentication measures.
- Use the Services for any illegal or unauthorized purpose.
- Interfere with the access of any user, host, or network.
8. Referral Programs
Journoo may, from time to time, offer referral programs that allow you to receive benefits or discounts. Each program is governed by its own specific terms, which will be provided to you at the time of the offer. Journoo reserves the right to modify or terminate any referral program at any time.
9. Data Export
You may export your personal data at any time through your account settings. The data will be provided in a machine-readable format in compliance with relevant data protection regulations such as GDPR and CCPA.
10. Intellectual Property
Aside from your User Content, all other aspects of the Services, including the software, text, graphics, logos, and AI-generated prompts, are the exclusive property of Journoo and its licensors.
11. Termination
You are free to stop using our Services and may delete your account at any time. We reserve the right to suspend or terminate your account for non-payment or for a material breach of these Terms, with notice to you.
12. Disclaimers and Limitation of Liability
- Disclaimer for Mental Health: You acknowledge that Journoo is not a medical device and does not provide medical, psychological, or therapeutic advice. It is not a substitute for professional healthcare. If you are in crisis, please contact emergency services (911 or 988 in the U.S.) or a qualified mental health professional.
- “As Is” Service: The Services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind.
- Limitation of Liability: To the fullest extent permitted by law, Journoo AI, LLC, its affiliates, and its personnel shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Services.
13. Dispute Resolution
These Terms are governed by the laws of the State of Utah. We hope to resolve any disagreements informally. Before filing a claim, you agree to first contact us at [email protected]. If we cannot resolve the dispute within 60 days, you and Journoo agree to resolve the claim through final and binding arbitration conducted by the American Arbitration Association (AAA). You agree to waive your right to participate in a class-action lawsuit.
14. Changes to These Terms
We may modify these Terms from time to time. If we make a material change, we will provide you with at least 30 days’ notice via email or an in-app notification. Your continued use of the Services after the changes become effective constitutes your acceptance of the new Terms.
